Notes:  a) Security Deposit: Each stall is required a security deposit             $ 200 

b) All food stalls require food license, Council Temporary Food Stall License application fee: high risk $287.60, low risk $249.80

 

 

 

         PLEASE NOTE:

 

1.      The VCA-QLD will design the layout of the stalls/festival site, taking into account the number, type, category, selling products of the stalls registered etc… and allocate the stalls sites.

2.      Allocated stall sites shall be informed by 24/1/2018.

3.      Stall fee is payable by Monday 15/1/2018 as the latest.

4.      Stall holders must organise their own public liability insurance cover (known as “Certificate of Currency”) before the Festival and forward a copy of the Certificate of Currency to the Vietnamese Community-Qld as soon practicable. The stall holder will not be able to operate their stall unless and until they have taken out appropriate insurance cover.

5.      Stall holders have also read and accepted the Terms and Conditions as stated in the AGREEMENT handed out together with this application form.

6.      The Vietnamese Community in Australia Queensland Chapter (VCA/QLD) will NOT refund any monies paid. Please think carefully before making any booking commitment.

7.      The VCA-QLD can change the dates of the Tet Festival 2 times and cancel the event completely, due to bad weather. Stallholders will be notified by the VCA/QLD, of the changes of dates or the cancellation of the event by 6am on the first day of the festival.

In case of cancellation, the VCA/QLD will refund the hiring fee and the security deposit to the applicants. The VCA/QLD will not be responsible for any cost incurred by the Stallholder, as a result of the changes in the dates or the cancellation of the event.

8.      VCA-QLD may organise a meeting with council and food stall owners to explain health regulations, time, date and venue of meeting will be advised.

9.      To operate a food stall, stall owner must have a permit from BCC.

Stall Fee

 

The stallholder shall pay the agency the full stall fee (as specified in the APPLICATION FOR A STALL IN FESTIVAL- which forms part of this contract), due by Monday 15/January/2018.

Stall Structure:

 

Stallholders shall be responsible for the safety of the marquee, supplied by them. Engineering certificate may be required by the organiser.

Parking location

Stallholders will park in the Civic Centre carparks.

Inclement Weather

The event will continue in all but extreme weather conditions.  The event organiser will notify the stallholders of any cancellation ( See cancellation clause 16  attached in Terms & Conditions)

Event Layout

An event layout will be included in the stallholder information pack for reference.

Insurance

It is responsibilities of the stallholders to purchase their own public liability insurance.

 

 

TERMS & CONDITIONS

1.         Trading Time:

 

The 2018 Vietnamese Tet Festival will be operating from 4pm to 10pm on two nights Friday 9th and Saturday 10th February 2018 at the Civic Centre carparks, at the corner of Wirraway Pde. and Corsair Ave., Inala QLD 4077.

2.         Payment of hiring fee and deposit

2.1       The Stallholder must pay the hiring fee in full and bond deposit on or before the date specified.

2.2       The hiring fee and bond deposit may be forfeited if the Stallholder breaches any of the terms and conditions contained in this Agreement.

 

3.         Stallholder’s Covenants

 

3.1       Stalls allocation, set up & operation. 

(i)         The Stallholders shall accept the allocation of the stall site by the Organising Committee.  Stallholders must not exchange or swap sites without the written consent from the Organising Committee;

(ii)        Stallholders shall keep all their materials, equipment, trailers, coolrooms etc… within the boundaries of their nominated site and shall not extend their displayed goods or effect any distribution of information or services, beyond these boundaries.

(iii)       Stallholders are not entitled to assign, share or sublet all or part of their site without prior written consent from the festival organiser;

(iv)       Stallholders MUST consult with the organizer about any activities outside their allocated areas.  Decision will be made based on the overall view and beauty of the festival as well as the possible complaint from other stallholders (extra fee may apply).

(v)               Stallholders are allowed vehicle access to the event area as below:

·         On Friday, from 11am to 4.00pm to setup/prepare the stall and from 10.00pm to 11.00pm to clean up the stall.

·         On Saturday, each stall shall have 2 hours of vehicle access to restock/prepare the stall during the period from 7.00am to 4.00pm. Packing up and dismantling the stall shall be from 10pm to 11pm.

·         Outside the above periods, all vehicles, trailers etc… must be out of the event area; except food vans etc… that had special permission to stay inside.

 

3.2       Permitted use

(i)         The Stallholder MUST NOT use the stall for any purpose other than the permitted use as prescribed in registration form.

(ii)        All stalls are definitely NOT allowed to display, sell and promote any type of products, documentation and information which propagate for the Communist Regime.

(iii)       Stallholders MUST NOT commit any act that brings the reputation of the Vietnamese Community in Australia into disrepute

3.3       Vehicle access to the event area.

(i)         The Organising Committee will provide entry tickets for stallholders to take vehicle into the event area as per 3.1(v) above:

·         6m – 9m wide stall: 2 entry tickets for 2 vehicles.

·         3m wide stall: 1 entry ticket for 1 vehicle.

(ii)        Stall holders have to show entry ticket to the parking team and follow their directions for parking.

3.4       Vouchers.

The festival organiser will issue “vouchers” for staff and workers etc… to be spent at stalls in the festival.  Stallholders shall accept them and then redeem from the VCA-QLD.

4.         Food License and Food Safety

 

4.1       All Food stalls must have current appropriate Food License displayed. (Please check with BCC or Organizing Committee for more information on Food licensing).

4.2       Stallholders must strictly adhere to Council rules and regulations regarding food and beverages and ensure that the food and beverages sold in their stalls meet the required HEALTH standards set out by appropriate authorities.

4.3       Food stalls whose sell food with “skewers” such as grilled pork balls, “Bo la lot”… MUST take the “skewers” out before serving them to customers.

 

5.         Sound

 

5.1       Sound emitted from a stall must be to a reasonable level, within the vicinity of the stall (not more than 65bd);

5.2       All sound system MUST be turned off during the opening ceremony (6pm to7pm);

5.3       All sound systems MUST be turned off at 10:30pm according to requirement of police and council.

 

6.         Electricity

 

6.1       All electrical appliances MUST be tested and tagged in compliance with AS 3760 for a current 3 months period. Leads and appliances will be inspected for a current test tag before access to power is given. No testing or tagging will be carried out on-site. All power boxes on-site will be locked.

6.2       All electrical leads must be at least 15A;

6.3       Each stall shall not have total demand exceeding the following limits at any time during the festival:

·           Information, display stalls...: 2000W

·           Food, drink stalls...: (Stalls: Width x Depth)

- single (3mx3m or 3mx6m):   3500W

- double (6mx6m):                   7000W

- large (9mx6m):                      14000W

6.4       Standard electric power points are provided, maximum 20m from any stall. However, stallholder will need lights, power boards; extension leads etc…to suit their own needs.

6.5       Stalls with coolrooms that need electricity continuously must contact the organiser to make necessary arrangements as the number of generators/power points will be reduced during low demand periods.

 

7.         Water

Water supply is available on site.

 

8.        Rubbish handling and Clean up

8.1       Each stall holder is responsible for the cleaning of their allocated site and other allowed area as in cause 6g and within two meters of surrounding areas at the end of trading.

The VCA/QLD will refund the security bond to Stallholders at Vietnamese Community Centre in the week after the festival if stallholder has done a proper cleaning as assessed by the VCA/QLD.

8.2       Stallholders MUST supply enough rubbish bins: 54-litre bin or wheelie bin, with suitable bin liners to temporarily hold rubbish from their stall and from their customers.

8.3       Each stallholder is responsible to empty their bins frequently during the festival, into the industrial waste bin (skip bin), not the wheelie bins, provided by VCA/QLD on the site, to keep the stall area clean.

8.4       Each stallholder is responsible ensuring that food waste is wrapped in plastic bags before being placed in the bins.

 

9.         Fire Safety & Security

 

9.1       Stallholder shall take special care to the fire safety in the cooking area of his/her food stalls.

9.2       Stallholder shall have a fire-extinguisher at its stall at all time.

9.3       All hot cooking equipment must be kept far away from the public. All food warming bain-marie shall have warning sign of “HOT SURFACE” on all hot surfaces.

9.4       The Organiser will arrange for the whole event site patrolled from 10pm Friday to 6am Saturday.

 

10.       Pets or live stocks:

No pets or livestock are permitted on the festival site.

11.       Right of Entry:

 

The VCA/QLD shall have the right to send its representatives to enter any stalls at all reasonable times during the festival for the purpose of making periodic inspections to ensure the Terms and Conditions of this Contract are being observed by the Stallholder and to inspect the premises and the products.

12.       Insurance

12.1     It is the stallholders’ responsibilities to purchase their own public liability insurance

12.2     Stallholders are responsible and liable for any injuries to customers, employees and contractors at their stall and/or as a result of their activities.

12.3     The responsibility of the stallholders also includes any loss/damages to properties belonging to others within their allocated sites eg. hired tent, pavement surface etc...

13.       Indemnity & Release

13.1     The stallholder must ensure to maintain insurance for the full period of the event.

13.2     The stallholders acknowledge that they shall conduct the business at their own risk and agrees not to make any claim against the event organizer, it's employee and/or agent for any losses including losses or damage of property due to thefts or losses of profit.

13.3     The Stallholder releases the event organizer, its employee and/or agent against any loss, damage or injury which may be sustained by the Stallholder or any of its servants or agents in or arising out of the exercise of the Stallholder in respect of the use or operation of the stall under this Agreement.

13.4     The Stallholder indemnifies and agrees to keep the event organizer, it's employee and/or agent from and against any actions, suits, claims, demands, proceedings, losses, damages, compensation, sums of money, costs, charges and expenses arising out of its occupation of the stall or any matter whatsoever in relation to the festival.

13.5     Stallholders shall promptly advise the VCA/QLD in writing of any action, suits, claims, demands, proceedings, losses, damages, compensation, sums of money, costs, charges and expenses which may be bought or claimed against the Stallholders or for which the VCA/QLD may become liable arising out of the occupation of the stall by the Stallholder

14.       Behaviour of Stallholders

 

Stallholders and their associated personnel must, at all times, act in a courteous and polite manner. Aggressive or abusive behavior as determined by the VCA/QLD will result in the closure of the stall and termination of this agreement.

15.       Compliance with rules of Civic Centre Body Corporate

 

Stallholders must comply with the rules and requirements of the venue owner, Inala Civic Centre Body Corporate to prevent damages to their property. Please contact the organiser for more details.

16.       Cancellation/Changes to the dates of the Tet Festival

The VCA/QLD can change the dates of the Tet Festival 2 times and cancel the event completely, due to bad weather. Stallholders will be notified by the VCA/QLD, of the changes of dates or the cancellation of the event by 6am on the first day of the festival. The VCA/QLD is not responsible for any cost incurred by the Stallholder, as a result of the changes of the dates or the cancellation of the event.

17.       Breach of Agreement

In the event that the Stallholder is in breach of any provision of this Agreement, the Organising Committee shall be entitled to terminate the Agreement and request the Stallholder to immediately vacate and remove all their belongings from the Festival venue. The Organising Committee shall also be entitled to sue the Stallholder for damages.

18.       Disclaimer

 

The VCA/QLD shall not be liable for any failure or any omission to carry out and observe any of the conditions of this Contract if such failure or omission is cause by circumstances beyond its control such as, but not limited to, acts of God, fire, accident, severe weather conditions, interruptions to energy supply, strikes, material shortage, mobilisation, war declared or undeclared or any acts of parliament.
